Terms and Conditions of Sale UAE

These Terms and Conditions of Sale (“Terms”) apply to purchases made on the UAE version of www.graff.com (“Site”). Please read them carefully before placing an order.

By placing an order through our Site, you agree to be bound by these Terms.

Who we are

For sales within the United Arab Emirates, products are sold by Graff Diamonds Limited (“Graff”, “we”, “us”, “our”).

Contacting you

We may contact you via email, telephone, SMS, WhatsApp or other messaging services regarding your order, delivery or customer service matters.

“Writing” includes email and electronic communication.

2. ELIGIBILITY TO PURCHASE

To place an order on the UAE Site, you must:

• Be at least 18 years old;
• Have legal capacity to enter into binding contracts;
• Be resident in the UAE or request delivery within the UAE.

We reserve the right to refuse orders that do not meet these requirements.

3. PLACING AN ORDER

After selecting products and completing checkout, you submit your order by clicking the relevant confirmation button.

You may receive an acknowledgement email confirming receipt of your order. This does not constitute acceptance.

We may perform identity verification, fraud prevention or payment validation checks prior to accepting your order.

4. ACCEPTANCE OF YOUR ORDER

A binding contract is formed only when we send you a dispatch confirmation email.

If we cannot accept your order, we will inform you and no charge will be made. Reasons may include:

• Product unavailability
• Payment authorisation failure
• Pricing or description errors
• Suspected fraud or non-compliance with eligibility requirements
• Inability to deliver to the requested address

We reserve the right to limit quantities per customer.

5. PRODUCTS

We take reasonable care to ensure descriptions, images and prices are accurate.

However:

• Images are illustrative only. Colours and size appearance may vary depending on device display.
• Carat weights are approximate and may vary slightly.
• Measurements provided are indicative.

Customised or Made-to-Order Products

Some products may be resized or customised. Customised products may not be eligible for return or refund except where defective.

You are responsible for providing accurate measurements.

Packaging may differ from website imagery.

6. PRICE AND PAYMENT

All prices displayed on the UAE Site are in AED and include UAE VAT where applicable.

We accept payment methods displayed at checkout.

We may pre-authorise payment at the time of order and charge your selected method at dispatch.

If VAT rates change before dispatch, we may adjust pricing accordingly where required by law.

If a pricing error is obvious and unmistakable, we reserve the right to cancel the order and refund any sums paid.

7. DELIVERY

We deliver within the United Arab Emirates using specialist secure delivery partners.

Delivery costs and estimated timeframes are shown at checkout.

Delivery dates are estimates and may be affected by events beyond our control. If a significant delay occurs, you may contact us to cancel and receive a refund for undelivered products.

Risk passes to you upon delivery to you or a person authorised by you.

Title passes once full cleared payment is received.

If delivery cannot be completed and you fail to rearrange delivery within a reasonable time, we may cancel the contract and refund the purchase price.

Boutique collection may be available where indicated.

8. DEFECTIVE OR NON-CONFORMING PRODUCTS

If a product is defective or not as described, you may be entitled under applicable UAE consumer protection laws to repair, replacement or refund.

You must notify us within a reasonable period after discovering the defect.

We may inspect the product before confirming the remedy.

9. OUR RIGHT TO SUSPEND OR TERMINATE

We may suspend or cancel the contract if:

• Payment cannot be processed;
• Fraud or unlawful activity is suspected;
• You breach these Terms.

10. LIMITATION OF LIABILITY

Nothing in these Terms excludes liability where it cannot be excluded under applicable UAE law, including liability for death or personal injury caused by negligence, fraud or statutory consumer rights.

To the extent permitted by law:

• We are not liable for indirect or consequential losses.
• Our total liability shall not exceed the purchase price paid for the product giving rise to the claim.

Products are supplied for personal use only. Commercial resale is prohibited.

11. PERSONAL DATA

Your personal information will be processed in accordance with our UAE Privacy Policy.

12. FORCE MAJEURE

We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to acts of government, customs delays, security incidents, natural disasters or supply chain disruption.

13. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the United Arab Emirates.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the UAE, unless otherwise required by mandatory consumer protection law.

14. GENERAL

If any provision is held invalid, the remaining provisions remain enforceable.

We may amend these Terms from time to time. The version applicable to your order is the one in force at the time you place your order.

No third party has rights to enforce these Terms.
